Legal Notice Terms and Conditions

1. Supplier Identification

 

'Greensmith.info'  is a site operated by Dennis Greensmith. 'Greensmith Music' is the registered operating name of my company that is used for Publishing and Copyright purposes. 'Guitarfingers' is a name used to promote published music material.

2. Privacy Policy

This relates to the use of your Personal Data, Cookies and any information relating transactions between myself as the supplier and you as the customer.

We can only provide the goods and services ordered by you if you provide us with your personal data. For the purpose of providing these services, we collect personal data about you such as Name, email, address. We will use the information you provide for the purposes described in this privacy policy to which you agreed to at the time your data was obtained. Your personal data will be used to provide the information, goods and services offered through our website to you, for billing and order fulfilment.

I do not use your data for marketing or advertising purposes. Your data is never passed to any other third parties. You can request (by email to teaching@greensmith.info) that your contact data is removed from my database (except when on invoice receipts which are held for legal accounting purposes).  I do not use Cookies on this website and my website does not collect any personal information as part of the monitoring administration process provided by the website provider (Ionos.com)

3. Supply of Services

Under consumer protection law you have right to cancel the provision of services in a 14 day cooling off period following payment (see 4 Rights to Cancel). In the contract you enter between yourself and me I have stated:

a) I will supply services before the end of the 14 day cooling off period, and

b) stipulated delivery schedules that are enacted before the end of the 14 day cooling off period.

In order for a) and b) above to be enact I need to bring to your attention and ask your permission for the Consent of the supply of services shown below and this will asked you agree this during the ordering process as shown below:

Consent to the supply of services (to be acknowledged and agreed by you during the order process started in your order and in text 'I' means you the customer)

'I expressly request you to start the service during the legal cooling off period and acknowledge that my right to cancel the contract will be lost once the contract has been fully performed. I recognise that I will have to pay for the services provided if I cancel the contract despite my express request to start the service within the legal cooling off period.'

This means that you can only cancel the order and receive a refund (if you have made a payment) before a product has been dispatched by me by post (I will have a Royal Mail delivery number as I send Registered Delivery) or email for PDF books and sheet music.

For Digital Delivery of pdf format Books and sheet music Your 'Right to Cancel' and my 'Supply of Service', Payment and Delivery conditions are clearly explained in the Legal Notice and Terms and Conditions - please read this before making an order. For the supply of digital pdf format you are agreeing the following statement in agreeing to the Terms and Conditions on this Legal Notice -  'I (the customer) consent to the starting of the supply of the digital content during the legal cooling off period and I (the customer) acknowledge that my right to cancel the contract will be lost with this consent to start the supply of the digital content'

The technical level of all Books and Sheet Music (including pdf download) are described fully in the product description and videos are available to be viewed via the free access tuition videos on this website and available on the Guitarfingers YouTube channel so the technical level can be assessed by the purchaser.

4. Right to Cancel

The Consumer Contracts Regulations give consumers extra protection when buying online. They provide consumers with a statutory right to cancel an order, within 14 Days, consumers are entitled to a refund, even if the goods are not defective.

Noting Section 3 above I have to ask the customer to only enact the Right To Cancel before product dispatch - this is notified to you now and during all stages of the order placement where you are asked to read and agree to the all the Terms and Conditions (at the final stages of the order process).

This means that you can only cancel the order and receive a refund (if you have made a payment) before a product has been dispatched by me by post (I will have a Royal Mail delivery number as I send Registered Delivery) or email for PDF books and sheet music.

To do this you must confirm this to me in an email as I have stated in Section 3 Supply of Services I am requesting you agree to the provision of the Service prior to the 14 days cooling off period. Therefore once this is done and payment made and delivery made then you lose the right to cancel. If you wish to cancel the order before delivery has been enacted then please email me ( I have suggested some text below you can use but you can use your own text.

5. Payment

Any purchase made from this website is not refundable once a product has been dispatched into the postal service by myself or PDF document has been sent by email. I do not accept returns.

All payments and transactions (including refunds) between myself and a customer are by PAYPAL only for security. Setting up a PAYPAL account is free and easy at PAYPAL.

A refund can given prior to product dispatch if payment has been made and is subject to the conditions in the Rights to Cancel and Supply of Service conditions in these Terms and Conditions. This will be PAYPAL transfer only.

The technical level of all Books and Sheet Music (including pdf download) are described fully in the product description and videos are available to be viewed via the free access tuition videos on this website and available on the Guitarfingers YouTube channel so the technical level can be assessed by the purchaser.

6. Delivery Schedules

When you email me you will receive and auto-response stating when you can expect to receive a response from me. During any holiday periods I take you I may not be able to fulfil our order until I return to work.

Physical Books are delivered free of Post & Package to UK mainland addresses. For other non-mainland UK postcodes please request a delivery charge by contacting me by email at teaching@greensmith.info Non UK addresses can only purchase pdf develivery versions of these books.

Physical Books ordered before 3 pm Monday to Friday should be dispatched 1st Class delivery the same day subject to successful payment confirmation before 3pm. Orders made after 3pm weekdays will be dispatched the next day 1st Class subject to payment confirmation. Orders made on Saturday and Sunday will be dispatched 1st class on Monday following payment confirmation.

Orders of PDF Books and Sheet music made before 3pm Monday to Friday will normally be sent the same evening subject to payment confirmation. Orders made after 3pm weekdays will be dispatched the next day and orders made on Saturday or Sunday will be dispatched Monday Morning subject to payment confirmation.
